Welcome to Hello Funding LLC (“Hello Funding,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of this website (the “Site”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1) Purpose of the Site; No Commitment to Fund

Hello Funding provides business-financing services for qualified small- and medium-sized businesses. Information on the Site is for general informational and marketing purposes only and does not constitute a commitment to fund, approve, or extend credit.
Hello Funding is not a lender or finance provider. Any financing, if offered, will be made under separate terms and agreements issued by the offering party and is subject to that party’s review, approval, and conditions.

2) Eligibility; Your Responsibilities

You represent that you are at least 18 years old and authorized to act on behalf of a business. You agree that all information you submit is accurate, current, and complete, and you will promptly update it as needed. We may rely on the information you provide when evaluating your inquiry.

3) Submissions; Reliance; No Professional Advice

Content on the Site is provided “as is” for general guidance only and does not constitute financial, legal, tax, or accounting advice. You should consult your own advisors regarding any financing decision. We may review information you submit to assess potential eligibility for available financing programs.

4) Privacy; Data Practices

Your use of the Site and any information you submit are governed by our Privacy Policy, which explains what we collect and how we use and protect it. By using the Site, you consent to our data practices as described there.

5) Electronic Communications & Consent (TCPA/CTIA)

If you provide contact details, you consent to receive calls, emails, and text messages from Hello Funding regarding your inquiry or account.

Consent is not a condition of credit or purchase.

You agree not to: (a) misuse the Site; (b) submit false or misleading information; (c) attempt to gain unauthorized access to any systems; (d) interfere with Site operation (e.g., by introducing malware or automated scraping outside normal browser use); or (e) use the Site for unlawful purposes.

9) Site Availability and Security

We do not guarantee that the Site will always be available, uninterrupted, or error-free. You are responsible for implementing sufficient procedures and safeguards for your own security and data backup needs.

10) Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, HELLO FUNDING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that information on the Site is complete, accurate, or current.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HELLO FUNDING OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability for any claim arising from or related to the Site shall not exceed $100.

12) Indemnification

You agree to defend, indemnify, and hold harmless Hello Funding and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your (a) use of the Site, (b) violation of these Terms, or (c) violation of any applicable law or third-party rights.

13) Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Clark County, Nevada for any dispute not subject to arbitration under Section 16.

14) Changes; Termination; Suspension

We may modify the Site or these Terms at any time. We will post updated Terms with a revised effective date. Your continued use of the Site after changes means you accept the updated Terms. We may suspend or terminate your access to the Site at any time, with or without cause or notice.

15) Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
No Waiver. Any failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent; we may assign them without restriction.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hello Funding regarding the Site.

16) Compliance Statement

Hello Funding LLC complies with applicable federal and state commercial-financing regulations, including disclosure requirements where such laws apply. All financing, if offered, is provided under independent provider terms and conditions and is subject to review and approval.

17) Arbitration; Class Action Waiver

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration on an individual basis under the Commercial Arbitration Rules of the American Arbitration Association.
The arbitration shall take place in Clark County, Nevada, before a single neutral arbitrator.
No class or representative actions are permitted. Each party waives any right to participate in a class action, private-attorney-general action, or any other proceeding in which a party acts in a representative capacity. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

18) Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or related to these Terms or the Site must be filed within one (1) year after the claim accrues; otherwise, it is permanently barred.
